Terms of use of the online store

1. Definitions

1.1. Pas Auto sp. z o.o. seated in Kuznocin 55, 96-500 Sochaczew. Owner of the online store, hereinafter referred to as Pas Auto sp. z o.o.

1.2. Seller – Pas Auto sp. z o.o.

1.3. Online store – a group of websites owned by Pas Auto sp. z o.o., available at the Internet address

1.4. Rules and Regulations – these Rules and Regulations define the principles that constitute the legal basis for the use of the Internet Store. The provisions of the Regulations, together with the provisions of the law in force on the territory of the Republic of Poland. Exclusively determine the rights and obligations of the Store’s Customers, as well as the rights, obligations and responsibilities of entities having the rights to conduct and administer services made available through the Internet Store. These Regulations constitute a set of universal rules, applicable to all customers of the store, although there may be further restrictions on the use of the store by customers, resulting from technical and/or legal conditions.

1.5. Store Customer – a person of legal age visiting the Online Store, who has sent to the Seller a completed order form and accepted these Regulations and who has the right, subject to the rules of the Regulations, as well as the instructions, passwords and links provided in the Online Store itself, to use all the opportunities it offers.
1.6 User – any person using to a limited extent the resources of the Online Store, i.e. without completing the registration procedures, if such opportunities have been made available by Pas Auto sp. z o.o.. Lack of registration procedure, in particular, does not exclude the User’s liability as specified in item 3 of these Regulations.

1.7 Registration – filling in by the Customer of the store the product purchase form located on the website of the Online Store, by providing personal data, contact details and e-mail address. Filling in the order form is required to conclude a Sales Contract between the Seller and the Store Customer.

1.8. Password – received with the purchase confirmation email, which, together with the email address, is required for logging in.

1.9. Sales Contract – a contract concluded between the Seller and the Customer of the online store, in accordance with the procedure specified in these Regulations.

1.10. Delivery – delivery by the Seller, to the Customer, of the ordered goods, constituting performance by Pas Auto sp. z o.o. under the Contract of Sale. Delivery may be made by the Seller’s own transport or by using the services of external companies.

2. General Information

2.1. The Internet store operating at the following web address, is run by Pas Auto sp. z o.o. with its registered seat in Kuznocin 55, 96-500 Sochaczew entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the city of Warsaw, XIII Economic Department of the National Court Register under NCR: 0000756976, REGON: 381777213, VAT: 1132987417.

3. Rights and obligations of the Customer and the User

3.1 The Store Customer/User is obliged to provide Pas Auto sp. z o.o. with a completed order form. Each time a Store Customer/User logs in to the Online Store website, it is tantamount to accepting these Regulations.

3.2 The Store’s/User’s Customer is obliged to use the Online Store in a manner that does not violate the law, the rights of third parties, the rules of social coexistence and these Regulations.

3.3. the store’s Customer/User is obliged to refrain from any actions that may hinder or interfere with the operation of the Online Store and the use of its resources and functionalities offered by it in a manner that is burdensome to other Users.

3.4 Completion of the Order form by the Customer/User is tantamount to his/her statement that:

a) the data provided in the Order form are complete and consistent with the facts,

b) he is familiar with the Terms and Conditions and undertakes to comply with them.

3.5 It is not allowed to post comments or opinions to products that:

a) contain personal and contact information,

b) are advertisements or promotion of own or foreign business,

c) contain content that is considered SPAM – not thematically related to the commented product, or are content resembling announcements and advertisements,

d) constitute the dissemination of pornographic content,

e) violate Polish or international laws, decency, moral standards,

f) offending the dignity or violating the personal rights of other persons or companies,

g) supporting radical social attitudes or proclaiming such views (racial, ethnic, gender, religious and other discrimination),

h) prevent or significantly impede the ability of others to use the resources of the Online Store.

3.6 Liability of the store Customer/User:

In the event of any claims by third parties against Pas Auto sp. z o.o. on account of infringement of law (including copyright, trademark rights, principles of fair competition, principles of social coexistence), personal rights (including image rights) by posting comments, descriptions or other materials, including links leading to external sites in the Online Store by the Store Client/User – the Store Client/User undertakes to take, at his/her own expense and risk, all legal steps to ensure adequate protection of Pas Auto sp. z o.o. against such claims. In particular, he undertakes to act as a defendant in the place of Pas Auto sp. z o.o. or, if this is not possible, to join on the side of Pas Auto sp. z o.o. in any proceedings pending against Pas Auto sp. z o.o..
It also undertakes to indemnify Pas Auto sp. z o.o. from liability in accordance with Article 392 of the Civil Code and to pay all costs that Pas Auto sp. z o.o. incurs or is obliged to pay to a third party in connection with a claim or lawsuit for infringement of copyright, personal rights, related rights or trademark rights and any other rights that this person claims in connection with the infringement of its rights.

4. Descriptions of goods

4.1 Product descriptions presented on the pages of the Online Store are in accordance with the facts presented by the supplier of the products.

4.2 The Seller shall not be liable for errors in descriptions resulting from the presentation to him of incorrect or misleading information by the manufacturer or distributor of the product.

4.3 The Seller shall not be liable for changes that are introduced by the manufacturer or distributor without informing the Seller.

5. Ordering

5.1 Orders may be placed 24 hours a day, throughout the year. However, the Seller reserves the right to stop accepting and processing orders in the following cases:

a) on holidays and public holidays,

b) when the stock of goods is exhausted,

c) during technical interruptions necessary for the proper functioning of the Online Store,

d) for reasons beyond the Seller’s control.

5.2 In order to place an order, the Customer/User of the Online Store is obliged to provide current and factually correct personal data, contact details – including shipping address, electronic mail address (e-mail). This is necessary to perform the obligations under the Sales Agreement.

5.3 Placing an order constitutes an offer within the meaning of the Civil Code, made to the Seller by the store’s Customer/User. After placing an order, a message is sent to the e-mail address presented in the ordering process to confirm the order. It is tantamount to confirmation by the store’s Customer/User of the conclusion of the Contract of Sale.

5.4 The choice of the form of payment (payment during the ordering process by means of online payment carried out by the partner or finalization of the cash on delivery transaction to the selected courier), where the Customer/User is obliged to choose one of the above.

5.5 In the case of selection of the payment method on delivery, the Seller shall proceed to process the order immediately after the Customer/User confirms the Sales Agreement.

5.6 In the event that it is not possible to execute the Contract of Sale in accordance with the order of the store Customer/User due to the absence of any of the items of the order, the store Customer/User will be contacted by an employee of the Seller to determine the terms of execution of the Contract of Sale. The order will be fulfilled without the missing items when the store Customer/User agrees to it. If the Store Customer/User does not agree, the Sales Contract will expire.

5.7 Delivery time of ordered goods usually does not exceed 7 working days, from the date of receipt of payment to the account indicated by the Seller or the moment of confirmation of willingness to pay for the goods on delivery, however, the Seller reserves the right to deliver the goods at a later date, not exceeding 10 working days from the conclusion of the Contract of Sale.

5.8 The store’s Customer/User has the right to check, in the presence of the courier company’s employee, whether the delivered goods are in accordance with the order. The signature of the store’s Customer/User on the waybill, signifies confirmation of compliance of the Delivery with the Sales Agreement.

5.9 The offer is available until stocks are exhausted. Due to the limited quantity of goods, orders placed after the stock is exhausted will not be able to be fulfilled, of which the store’s Customer/User will be informed by telephone, or e-mail by an employee of the Seller.

6. Forms of payment

6.1 Customers of the store/Users may use the following forms of payment: cash on delivery, paid in cash at the time of receipt of goods or payment by online transfer using the payment service selected by the seller or payment by bank transfer in the traditional form in accordance with the provided bank details.

7. Prices

7.1. All prices given in the Online Store are given in euro, are gross prices, including VAT. Prices given in the Online Store do not include the cost of Delivery, which is added separately to the order.

7.2. The prices given are valid at the time of placing an order by the Store’s Customer/User.

7.3.The Seller reserves the right to change the prices available in the store, to terminate sales before the time specified on the website of the Online Store and to cancel any kind of promotional actions and sales.

8. Withdrawal from the sales contract

8.1. The Store’s Customer/User has the right to withdraw from the Sales Agreement without giving any reason within fourteen days from the date of receipt of the shipment with the ordered goods, making a statement to this effect to the Seller in writing or by contacting the indicated telephone number of the Store.

8.2. In the event of withdrawal from the Contract of Sale, the Store’s Customer/User will receive a refund of the equivalent of the price of the purchased goods, whereby he/she is obliged to send back the received goods in an unaltered state, originally packed and undamaged, together with a legibly completed return card, a sample of which he/she will receive after prior contact with the Store’s Office.

8.3. Returns of goods should be addressed to the address of the warehouse of Pas Auto sp. z o.o., the exact address of which is given on the website .

8.4. Return of the equivalent of the price of the purchased goods will be made to the bank account number indicated by the Customer of the store / User.

8.5. The right of withdrawal from the Sales Agreement is not granted to the customer of the store/User in cases:

a) the provision of services started with the Customer/User’s consent, when this commencement took place before the expiration of the fourteen-day period within which the Customer of the store/User may withdraw from the Sales Agreement,

b) concerning audio and visual recordings and recorded on computer program media after the Customer of the store/User has removed their original packaging,

c) contracts for services for which the price or remuneration depends exclusively on the movement of prices on the financial market,

d) services with the properties specified by the store’s/User’s Customer in the order placed by him or closely related to his person,

e) services which, due to their nature, cannot be returned or whose object is subject to rapid deterioration,

f) delivery of newspapers,

g) gaming and betting services.

8.6 The cost of returning the goods to the Seller shall be borne by the customer of the store/user and is not refundable.

9. Complaints

9.1. 9.1 If the purchased goods have defects, the Seller will, at its option, repair the goods, send them to the manufacturer for repair, replace them with goods free of defects, refund the price paid in whole or in part. If the goods purchased by the Customer are not available, the Seller may offer goods with similar parameters.

9.2. The transfer of the defective item to the Seller shall be at the expense of the Customer of the store, and the parcel shall be accompanied by a proof of purchase, delivered at Delivery.

9.3. The time limit for processing complaints is 14 days. In special cases, beyond the control of the Seller, this period may be extended.

9.4. After consideration of the complaint, the goods will be transferred to the customer of the store at the expense of the Seller. In the case of reimbursement of the equivalent of the price of the advertised goods, the Shop Customer undertakes to provide the Seller with the bank account number to which the transfer will be made.

10. personal data protection, confidentiality

10.1 When using the Online Store (consisting of registering an account, placing orders, subscribing to a newsletter), the Customer provides his/her personal data. Providing personal data by the Customer is voluntary, however, it is necessary to make purchases and use those services provided by the Store that require personal data.

10.2 The administrator of the personal data referred to in item 10.1 is Pas Auto sp. z o.o. with its registered seat in Kuznocin 55, 96-500 Sochaczew, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the City of Warsaw, 13th Commercial Department of the National Court Register under the number NCR 0000756976, VAT 1132987417, REGON 381777213.

10.4. The Administrator has appointed a Personal Data Protection Supervisor, who can be contacted in writing, by means of snail mail writing to: Kuznocin 55, 96-500 Sochaczew or by e-mail at: . The Inspector will be happy to assist you in all matters related to the protection of personal data, in particular to answer questions about the processing of your personal data.

10.5. By providing data, the Customer declares that the personal data provided by him/her are his/her data.

11. Final Provisions

11.1 In matters not covered by these Terms and Conditions, the applicable provisions of Polish law shall apply, in particular the Act on Electronic Provision of Services.

11.2 Any comments, complaints, comments and questions concerning the operation of the Online Store should be sent to or reported by mail to Pas Auto sp. z o.o. with the annotation “firextinguishers” or by phone at the hotline number 503 105 825. Pas Auto sp. z o.o. reserves the right to change these Terms and Conditions – with a two-week notice of its introduction. The amended Regulations will be published on the pages of the Online Store.

11.3 Any disputes arising between the Customer and the Seller in connection with the operation of the online store will be resolved amicably by them. Only if it is not possible to reach an agreement, either party will be able to refer the case for consideration by the Common Court of competent jurisdiction for the location of the Seller.
